Annotation on Active disclosure of inspection reports

The latest version of Jurisprudentie Geneesmiddelenrecht ("JGr”: 'Case law Pharmaceutical law’, ) contains an annotation by Hanneke Later-Nijland on the active disclosure of inspection reports by the Minister of Health, Welfare and Sports (ECLI:NL:RBROT:2019:4369).

The inspection report pertained to collegial delivery (‘collegiaal doorleveren'), a much debated topic. Somewhat surprisingly, the District Court of Rotterdam ignores the argument that the information in the product dossiers and the product information should fall under the exception of business confidentiality and that it concerns trade secrets whereby the disclosure should be restricted.
